Terms of Service
The terms for using PhotoForPass: one-time payments, what each order includes, promotions, photo rules, the 14-day money-back guarantee, disclaimers and arbitration.
Effective date: November 8, 2026
These Terms of Service (“Terms”) are a binding agreement between you and HELPERG LLC, a Wyoming limited liability company, 30 N Gould St, Ste N, Sheridan, WY 82801, USA (“PhotoForPass”, “we”, “us” or “our”). They govern your use of photoforpass.com and related services (the “Service”).
Please read these Terms carefully. Section 16 contains a binding arbitration agreement and class action waiver that affect how disputes are resolved if you live in the United States. You can opt out of arbitration within 30 days, as explained in Section 16.
By using the Service, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, our Refund Policy and our Biometric Data Notice. If you do not agree, do not use the Service.
1. What the Service does
PhotoForPass offers two kinds of products, all delivered as digital files:
- Document photos: passport, visa and ID photos sized to the rules for the document you select, as a digital file and, if your package includes it, a print-ready sheet you can print at home or at a store. Family packages cover more than one person.
- Keepsake products: portraits and cards created from your photo, such as Christmas portraits, Photo with Santa, family album portraits, couple portraits, memorial portraits, and greeting and Christmas cards.
Here is how it works:
- You upload a photo or take one in your browser, and choose a document or product.
- Before you pay, a free automated check runs in your browser and shows you the result.
- After a one-time payment, your photo is processed by automated tools, including third-party AI image models accessed through an AI gateway. For document photos, they adjust the background, lighting and framing, and we size and crop the result to the document’s specification. For keepsake products, they create new images based on the people in your photo and the template you chose.
- You download your finished files.
Not a government service
We are not affiliated with, endorsed by, or acting on behalf of any government agency, including the U.S. Department of State, U.S. Citizenship and Immigration Services, or any foreign passport, visa or immigration authority. You can get passport and ID photos from many other sources.
No guarantee of acceptance
We build document photos to meet each document’s published photo requirements, but the final decision to accept or reject a photo is made only by the issuing authority, and requirements can change without notice. Officials may reject a photo for reasons we cannot control, such as the photo not being a true likeness, how it was printed, or changes to their rules. Our Refund Policy explains what happens if your photo is rejected.
About automated and AI processing
- Document photos. Processing is intended to change only the background, lighting, framing and size. It is not intended to change facial features, identity or appearance. Many authorities forbid altered or retouched photos. Before you submit a photo, check that it is a true and current likeness of the person. If it is not, do not use it. Contact us for a regeneration or refund.
- Keepsake products. These are newly created images for personal enjoyment, not photographs of real events. For example, a Photo with Santa image shows a scene that did not happen. The people may not look exactly as they do in real life.
- Watermarks and metadata. Images edited or created by AI models may contain invisible digital watermarks or metadata, added by the model provider, that identify them as edited or created with AI. We do not remove them.
2. Eligibility
- You must be at least 18 years old, or the age of majority where you live, to place an order or accept these Terms.
- Users from 13 to 17 may use the Service only with the involvement and permission of a parent or legal guardian who accepts these Terms.
- Children under 13 may not create accounts or use the Service themselves. Parents and legal guardians may upload photos of their children, as described in Section 4.
- You may not use the Service if you are barred from doing so under applicable law, including U.S. sanctions laws.
3. Accounts
Accounts are optional. You can sign in with an email link or with your Google account, through Google Firebase Authentication. If you order without an account, your order is tied to the email address you provide, and we send your receipt and a private download link there.
You are responsible for keeping access to your email and Google accounts secure, and for activity under your account. Tell us right away at contact@photoforpass.com if you believe someone has accessed your account without permission.
4. Your photos and consent
- You need the right to use the photo. You may upload only photos that you took, own, or otherwise have the right to use.
- You need the consent of the people in it. You may upload a photo showing another person only if that person has agreed, or if you are the parent or legal guardian of that person (for example, a baby or child) or are otherwise legally authorized to act for them. By uploading, you confirm you have that consent or authority and that you have shared our Biometric Data Notice with them where required.
- Memorial portraits. You may order a memorial portrait of someone who has passed away only if you are a family member or close friend, or have the family’s permission, and you have the right to use the photo.
- Consent to processing. Before upload, we ask you to confirm consent to processing as described in our Privacy Policy and Biometric Data Notice. If the photo shows anyone else, you give that consent on their behalf and confirm you are authorized to do so.
5. Acceptable use
You agree not to:
- Upload a photo you do not have the right to use, or a photo of anyone without their consent or legal authority to act for them.
- Use a child or anyone under 18 in a couple portrait template. Couple portraits are for adults only, and both people must have agreed.
- Use photos of celebrities, politicians or other public figures, or of anyone else, to impersonate them, imply they endorse something, or create images they did not agree to.
- Upload or try to create sexual, nude or sexually suggestive content of anyone. Any content that sexualizes a minor is strictly forbidden, and we report apparent child sexual abuse material to the National Center for Missing and Exploited Children as US law requires.
- Impersonate any person, or create a document photo of someone who will not be the holder of the document.
- Use the Service to create, alter or support any fraudulent, counterfeit, forged or misleading identity document, or to deceive any government agency, employer, bank or other organization.
- Use any image from the Service to harass, bully, defame or deceive anyone, including by presenting a keepsake image as a real photograph in order to mislead.
- Upload content that is unlawful, violent, hateful, or that infringes anyone else’s rights.
- Upload malware, or try to probe, scan, overload, reverse engineer, scrape, or bypass the security, bot protection, checks or usage limits of the Service.
- Use bots or scripts to access the Service, or resell or provide the Service to others as a commercial offering, without our written permission.
- Use the Service in violation of any law.
We may refuse, suspend or cancel any order or account that we reasonably believe violates this section, and we may report suspected fraud or abuse to the appropriate authorities. If we cancel an order for a reason that is not your fault, we will refund it.
6. Prices and one-time payments
- One-time payments only. Each order is a single, one-time payment. There is no subscription and nothing renews automatically. We will never charge you again unless you place a new order.
- Prices. The price is shown in US dollars before you pay, along with any applicable tax. We may change prices for future orders at any time.
- Payment. Payments are processed by Stripe. We accept the payment methods shown at checkout, such as cards, Apple Pay, Google Pay and Link. We never see or store your full card number. Your use of Stripe is also subject to Stripe’s terms.
- Free check. The automated check before purchase is free. It is an estimate only and does not guarantee acceptance.
7. Promotions
From time to time we may show a welcome offer, such as a one-time 20% discount that expires 59 minutes after it is shown. Unless the offer says otherwise:
- It applies to one order only and is limited to one per customer.
- It cannot be combined with any other discount or offer.
- It expires at the time shown. After that, the regular price applies.
- It has no cash value and cannot be transferred or exchanged.
- If you get a refund on a discounted order, we refund the amount you actually paid.
We may end or change an offer at any time, but we will honor an offer you validly claimed before it expired.
8. What each order includes
- Document photos cover the number of people and the document type in the package you choose.
- Keepsake products include the number of images or files shown on the product page before you pay.
- Checks and regenerations. Unless the product page says otherwise, each order includes, for each person in the order, up to 5 photo checks and up to 3 additional regenerations if you want the result made again.
These allowances belong to the specific order. They have no cash value, cannot be transferred to another order or person, and end when the order’s photos are deleted under our 90-day retention schedule. If you need a different document type or a photo of another person, please place a new order. If a technical failure on our side uses up a check or regeneration, contact us and we will restore it.
9. Refunds
We offer a 14-day money-back guarantee, and a full refund if an issuing authority rejects your document photo, with one refund per order, as described in our Refund Policy. The Refund Policy is part of these Terms.
EU, EEA and UK consumers. You normally have a 14-day right to withdraw from a contract for digital content. At checkout, you ask us to start processing your photo right away and acknowledge that you lose the statutory withdrawal right once processing begins. Our voluntary 14-day money-back guarantee still applies, and nothing in these Terms limits your statutory rights for faulty digital content.
10. Delivery and storage
We deliver finished files as digital downloads through the Service and a private link sent to your email. We do not ship physical prints. We store uploaded photos and generated files for 90 days, then permanently delete them. Please download and save your files. After deletion, we cannot recover them. You can delete photos sooner from “My photos”.
11. Intellectual property
Your content
You keep all rights you have in the photos you upload (“Your Content”). Subject to these Terms, we assign to you any rights we have in the finished files we deliver to you (“Output”), except for our templates, designs, frames and card layouts, which we license to you as described below. Images created with AI may not be protected by copyright in some countries.
You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, analyze and modify Your Content and Output only as needed to provide the Service to you, including sending it to our service providers for processing, and only for as long as we store it under our retention schedule. This license ends when the content is deleted. We do not use Your Content or Output to train AI models, for marketing, or for any other purpose.
You confirm that you have the rights needed to grant this license.
Personal use of keepsake products
You may use keepsake Output for personal, non-commercial purposes, such as printing it, framing it, sending cards to family and friends, and sharing it on your personal social media. You may not sell it or use it in advertising without our written permission.
Our content
The Service, including our software, templates, designs, text, graphics, logos and the PhotoForPass name, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose under these Terms.
Feedback
If you send us suggestions or feedback, we may use them without any obligation to you.
Copyright complaints
If you believe content on the Service infringes your copyright, send a notice to contact@photoforpass.com with the information required by the U.S. Digital Millennium Copyright Act (17 U.S.C. 512(c)(3)).
12. Third-party services
The Service relies on third-party services, such as Stripe for payments, Google Firebase for sign-in, Cloudflare for hosting and storage, and AI model providers. We are not responsible for third-party services that we do not control, but we choose providers carefully and require them to protect your data as described in our Privacy Policy.
13. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT: (A) ANY GOVERNMENT AUTHORITY WILL ACCEPT YOUR PHOTO; (B) THE OUTPUT WILL MEET EVERY CURRENT REQUIREMENT OF EVERY AUTHORITY; (C) AUTOMATED OR AI PROCESSING WILL BE FREE OF ERRORS OR ARTIFACTS; (D) KEEPSAKE IMAGES WILL LOOK EXACTLY LIKE THE PEOPLE IN YOUR PHOTO; OR (E) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR REMEDY FOR A REJECTED OR UNSATISFACTORY RESULT IS A REFUND UNDER OUR REFUND POLICY.
WE ARE NOT RESPONSIBLE FOR DELAYS, FEES, MISSED TRAVEL, OR OTHER CONSEQUENCES OF AN APPLICATION BEING DELAYED OR REJECTED. WE RECOMMEND APPLYING WELL AHEAD OF ANY TRAVEL DATE.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, TRAVEL COSTS, OR GOVERNMENT FEES, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF THEM.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) US$100.
These limits do not apply to liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, fraud, gross negligence or willful misconduct, or our obligations under applicable privacy and biometric privacy laws to the extent those laws do not allow limitation. If you are a consumer in the EU, EEA or UK, these limits do not affect your mandatory statutory rights, and we are liable for foreseeable loss caused by our breach of these Terms.
15. Indemnity
If you are using the Service other than as a consumer, or to the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service, including uploading a photo of someone without their consent or using the Service to commit fraud.
16. Dispute resolution, arbitration and class action waiver
This Section 16 applies only if you live in the United States. If you live outside the United States, see Section 17.
16.1 Try to resolve it informally first
Before filing a claim, you agree to contact us at contact@photoforpass.com with a description of the dispute and the relief you want, and to try in good faith to resolve it for at least 60 days. We agree to do the same before filing a claim against you. Most issues can be resolved quickly with a refund.
16.2 Agreement to arbitrate
If we cannot resolve the dispute informally, you and we agree to resolve any dispute, claim or controversy arising out of or relating to these Terms or the Service by binding individual arbitration, rather than in court, except as stated below. This includes disputes about the scope or enforceability of this arbitration agreement, which the arbitrator will decide.
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, available at adr.org. The arbitrator may award the same individual relief a court could. Hearings may take place by video, by phone, or in the county where you live. For claims under US$10,000, the arbitration may be decided on written submissions unless either party requests a hearing. We will pay all AAA filing, administration and arbitrator fees for claims under US$10,000 unless the arbitrator finds your claim frivolous.
16.3 Exceptions
Either party may: (a) bring an individual claim in small claims court if it qualifies; (b) seek an injunction in court to stop infringement or misuse of intellectual property; and (c) report matters to government agencies.
16.4 Class action and jury trial waiver
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate claims of more than one person or award relief to anyone other than the individual party. If this class action waiver is found unenforceable as to a particular claim or request for relief, that claim or request must be severed and decided in court after the individual arbitration ends, and the rest of this Section 16 will still apply.
16.5 Mass filings
If 25 or more similar arbitration demands are filed against us by or with the help of the same law firm or organization within 90 days, the demands will be administered in batches of up to 25 under the AAA’s Mass Arbitration Supplementary Rules, with one arbitrator per batch, to the extent consistent with the AAA rules.
16.6 Opt out within 30 days
You may opt out of this arbitration agreement by emailing contact@photoforpass.com within 30 days after you first accept these Terms, with the subject “Arbitration opt-out” and your name and the email address you use with the Service. Opting out will not affect any other part of these Terms or your relationship with us. If you opt out, Section 17 applies.
16.7 Changes to this section
If we make a material change to this Section 16, it will not apply to any dispute you notified us about before the change. You may reject the change by emailing us within 30 days after it takes effect, in which case the previous version of this Section 16 will continue to apply to you.
17. Governing law and venue
These Terms are governed by the laws of the State of Wyoming and applicable US federal law, including the Federal Arbitration Act, without regard to conflict of law rules. Subject to Section 16, any claim that is not arbitrated must be brought in the state or federal courts located in Wyoming, and you and we consent to the personal jurisdiction of those courts.
If you are a consumer outside the United States, these Terms do not deprive you of the protection of mandatory laws of the country where you live, and you may bring claims in the courts of that country.
18. Changes to the Service and these Terms
We may change or discontinue parts of the Service. If we discontinue the Service, you can still download your files until they are deleted under our retention schedule, or ask for a refund for any order we can no longer deliver.
We may update these Terms. We will post the new version here and update the “Effective date”. If a change is material, we will give you reasonable notice by email or on the Service before it takes effect. Changes will not apply to orders you placed before the change. If you continue to use the Service after the effective date, you accept the updated Terms.
19. Termination
You may stop using the Service and delete your account at any time. We may suspend or end your access if you breach these Terms or if we must do so by law. Sections that by their nature should survive termination, such as Sections 11 through 17, will survive.
20. General
- Entire agreement. These Terms, together with the policies they reference, are the entire agreement between you and us about the Service.
- Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not transfer these Terms without our consent. We may transfer them in connection with a merger, acquisition or sale of assets, with notice to you.
- Force majeure. We are not liable for delays caused by events beyond our reasonable control.
- Languages. The Service is available in several languages, but these Terms are provided in English. If we provide a translation, the English version controls if there is a conflict, unless local law requires otherwise.
- Notices. We may send notices to the email address linked to your account or order. You can send notices to contact@photoforpass.com or by mail to HELPERG LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, USA.
- California users. Under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
